1. Who we are
These Terms & Conditions ("Terms") form an agreement between you and Built by swift, trading as TimesX ("TimesX", "we", "us"), the provider of the TimesX website and services at timesx.co.uk (the "Service"). If you use the Service on behalf of a business or organisation (for example, a school), you confirm you have authority to bind that organisation to these Terms.

2. What the Service is
TimesX is an online learning platform that helps children learn multiplication and times tables through activities, games and progress tracking. Parents and guardians open accounts and subscribe on behalf of their children; teachers may open accounts for classroom use. Accounts for children under 18 may only be created and managed by their parent or legal guardian, and individual users must be of legal age to form a binding contract or have their parent or guardian agree to these Terms on their behalf.
3. Accepting these Terms
By creating an account, subscribing, or using the Service in any way, you agree to these Terms. If you do not agree, please do not use the Service. Continued use of the Service after we publish changes to these Terms also constitutes acceptance. We will always show the date of the latest version at the top of this page.
4. Accounts and credentials
You are responsible for keeping your sign-in details (including your child's username and password) confidential and for all activity that happens under your account. You must provide accurate information when creating an account and keep it up to date. Tell us straight away if you think someone else is using your account.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose or in breach of any applicable law;
- commit or encourage fraud, send spam, or harass other users;
- copy, resell, redistribute, or infringe the intellectual property of TimesX or others;
- interfere with the security of the Service, including introducing malware, probing or scanning for vulnerabilities, scraping, or attempting to gain unauthorised access to accounts, systems or data;
- bypass or circumvent any technical limits, payment requirements, or locks on the Service;
- reverse engineer the Service except where permitted by law.
6. Payment and subscriptions
Access for each child requires an active subscription, currently priced at £3.99 per child per month, billed monthly in advance. Subscriptions renew automatically each month until cancelled. If you cancel, your child keeps access until the end of the period you have already paid for. We may change prices with reasonable notice before your next renewal.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation and refund mechanics are handled by Paddle and are governed by Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms.
7. Licence to use the Service
While you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your own personal, family or classroom use within the plan you have selected. You may not use the Service commercially, resell access, or share accounts between households or schools beyond the accounts you have legitimately created.
8. Intellectual property
The Service, including all software, design, text, graphics, games, branding and documentation, is owned by Built by swift trading as TimesX and is protected by intellectual property laws. We reserve all rights not expressly granted to you. You keep ownership of any content you or your child enter into the Service (such as progress data), and grant us a limited licence to host and process that content solely to provide the Service.
9. Suspension and termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access to the Service, with notice where reasonable, if:
- you materially breach these Terms and, where the breach can be fixed, fail to fix it within a reasonable time of being asked;
- payment for your subscription fails or is charged back;
- we reasonably believe your account poses a security or fraud risk;
- you repeatedly or seriously violate our policies or applicable law.
When access ends, we will delete or anonymise your account data in line with our Privacy Notice. We recommend exporting anything you want to keep before your access ends.
10. Service level and availability
We work hard to keep TimesX available and error-free, but the Service is provided "as is" and we do not guarantee that it will be uninterrupted, timely, or free of errors. We may modify, update, or discontinue features from time to time, and may carry out maintenance that temporarily affects availability.
11. Disclaimers
To the fullest extent permitted by law, we disclaim all implied warranties and conditions, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service supports learning but does not replace teaching, and we do not guarantee any particular educational outcome.
12. Limitation of liability
To the fullest extent permitted by law, TimesX is not liable for indirect, consequential or special damages, including loss of profits, data, or goodwill. Our total aggregate liability to you under these Terms is limited to the fees you paid to us (through Paddle) in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
13. Your indemnity
You agree to indemnify and hold us harmless from claims, damages and expenses arising from your use of the Service in breach of these Terms, your unlawful use, or content you or your child submit to the Service.
14. Changes to the Terms
We may update these Terms from time to time. The current version is always on this page with its "last updated" date. For significant changes that affect paying subscribers, we will aim to give reasonable notice (for example by email) before the changes take effect.
15. General
You may not transfer this agreement to someone else without our consent. We may transfer it as part of a merger, acquisition, or sale of assets. If any part of these Terms is found unenforceable, the rest stays in force. We are not liable for delays or failures to perform caused by events beyond our reasonable control (force majeure).
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.
